User Service Agreement and Privacy Policy
The User Service Agreement and Privacy Policy("The Agreement") and its terms establish the agreement between you and Shenzhen Hanzhi Technology Co. Ltd regarding the download, installation and use of the NexzDAS (hereinafter referred to as the "Software"), which describes the rights and obligations between you and the Software.
It is important that you read this Agreement carefully and fully understand its terms before registering, and if you have any objections, you may choose not to run the Software.
Once you confirm this user registration agreement, this Agreement will have legal effect between you and the Software, which means that you fully agree and accept all the terms of the Agreement. Please read it carefully and determine whether you accept the Agreement. (Minors should be accompanied by a legal guardian to read).
I. Use the Software
1. You will be a user of the Software when finishing registration according to the tips given on the page. The user should keep their accounts and passwords by themselves, and use them accurately and securely.
2. The user shall fully understand and agree that the user shall be responsible for his or her actions under the registered account, including the acquisition and modification of personal information, the uploading, loading and transmission of any content in the test reports as well as any consequences thereof, and that the user shall judge the content in the Software by himself or herself and bear all risks arising from the content one used. The Software shall not be liable for any damage caused by the user's actions.
II.Privacy Policy
We respect and protect the privacy of the person who uses the Software, and place a high priority on the protection of user privacy and personal information. This privacy policy helps you understand what data we collect, why we collect it, what we do with it, and how we protect it.
We will use your personal information in accordance with People's Republic of China Network Security Law, Information Security Technology Personal Information Security Specification and other relevant laws and regulations, industry-established security standards collection and this Agreement.Except as otherwise provided in this Privacy Policy, the Software will not disclose or provide this information to third parties without your prior consent.
1. Collection and use of personal information
(1) Registration: When registering and logging in to your account with the Software, you provide us with at least a cell phone number or email address and create your password. After successful registration, the above information provided by you will be continuously authorized to be used by us during the time you are enjoying the services of this software. When you cancel your account, we will stop using and delete the above information or anonymize your personal information, except as otherwise provided by laws and regulations.
(2) After successful registration with your cell phone number, we may collect the following information.
Device Information: In order to be able to serve you on your device, we may associate your device or phone number with your account and collect information such as device attributes, device status, and device links.
Customer Service: When you file a complaint, suggestion, or inquiry with the Software or when the Software handles related complaints, we may use personal information such as your name, phone number, email address, and other information provided by you in order to facilitate contact with you. If you refuse to authorize the above information, we may not be able to provide you with the results of your complaint, grievance or inquiry in a timely manner.
(3) To provide you with additional businesses of the Software and/or its services
In order to provide you with better products and services, we may need to collect the following information. If you decline to provide it, we will not be able to offer you certain features and services.
Location permission: for Bluetooth connection to our VCI devices
Camera permission: for scanning the product QR code to quickly bind the serial number
Microphone permission: for screen recording
Phone storage permission of reading and writing: for downloading and reading model diagnosis data and recording LOG, saving screenshots and screencasts
(4) Others: When we want to use the information for other purposes not contained in this privacy policy, we will seek your consent in advance. In accordance with laws and regulations, we will not be able to comply with your request in the following cases.
a. Related to national security or interest.
b. Related to public safety and interest.
c. Related to your or a third party's vital interests and may lead to serious damage.
d. Directly related to crime, judicial proceedings, governmental procedures, etc.
e. When you have subjective malice or abuse of rights (e.g. If your request would jeopardize public safety and the legitimate interests of others, or if your request is beyond the scope of ordinary technical means and commercial costs.)
f. Involved with trade secrets.
2. How we protect your personal information
In order to prevent the loss of your information, access without your consent authorization, public disclosure, leakage, transfer, etc. resulting in damage to your personal information, the Software will take all reasonable, reliable and feasible plans and measures to protect the security of your personal information.
(1) Security measures:
a. We will collect, use, store and transmit user information in accordance with national security standards and laws and regulations, and inform you of the purpose and scope of use of the relevant information through the user agreement and privacy policy. At the same time, we will apply encryption technology to personal information to ensure the confidentiality and security of the data.
b. Signing confidentiality agreements for those who have access to employee information, agreeing on legal responsibility for leaks, and providing regular training on security capabilities and awareness.Only authorized employees can access personal information. If the confidentiality agreement is violated, employees will be held legally responsible.
c. We establish a perfect information security management system and internal security incident disposal mechanism, etc.
(2) Retention period
a. We will continue to save your personal information for you for the duration of your use of the Software Services.If you make changes to your personal information, we will keep the modified information.
b. If you cancel your account, we will no longer use your personal information, and we will save your information and anonymize it in accordance with the provisions of the Network Security Law and other laws and regulations.
3. Your Right to Manage Personal Information
We take your concerns about your personal information seriously and make every effort to protect your rights to access and correct your personal information so that you have the full ability to safeguard your privacy and security. Your rights includes:

You have the right to access and correct your personal information at any time.You can view or modify your name, email, company name, nationality, birthday, cell phone number, address through [Me].
III. Personal Information of Minors
1. If you are a minor, it is recommended that your guardian carefully read the terms of this Privacy Protection Policy, and use our products and services or provide us with information with the consent of your guardian.
2. If your guardian does not agree to your use of our services or provision of information to us, please terminate your use of our services immediately and notify us promptly so that we can take appropriate measures.
3. If the guardian finds that we have collected personal information of minors without the guardian's consent, please contact us with feedback from the guardian, and we will delete your personal data as soon as possible after approving the relevant circumstances.
IV. Legal Liability and Exclusion of Liability
1. The software regularly checks and updates the software, and is not responsible for any interruption or suspension of normal services caused by unexpected events, force majeure, system failure, etc. The software will do its best to avoid service interruption and limit the interruption time to the shortest possible time.
2. The software is not responsible for any losses suffered by users due to third party such as communication line failure of telecommunication department, technical problems, network, cell phone failure, system instability of telecommunication department and various other force majeure reasons.
3. Users are requested to keep their personal information properly, provide adequate protection and backup of personal information, and take appropriate precautions to reduce the risk of cell phone viruses or other malicious and destructive actions.
4. Since your privacy is very important to the Software, the Software will not provide your personal information to unrelated third parties without reason, unless the authorities have the right to retrieve it according to the law, but will not be responsible for the consequences of information leakage caused by malicious infringement by third parties.
V. Intellectual Property Rights
1. This software is developed by Shenzhen Hanzhi Technology Co., Ltd. All intellectual property rights of the software and all content related to the software, including but not limited to: text expressions and their combinations, icons, ornaments, images, diagrams, colors, interface design, layout frames, relevant data, etc. are owned by Shenzhen Hanzi Technology Co.
Ltd. and are protected by copyright laws, international copyright treaties and other intellectual property laws and regulations.
2. Without the written consent of Shenzhen Hanzhi Technology Co., Ltd, the user shall not implement, utilize, transfer or license any third party to implement, utilize or transfer the above intellectual property rights for any profit or non-profit purposes.The company reserves the right to pursue the legal responsibility of those responsible for the above unauthorized acts.
VI. Changes and Notices
We may revise the terms of this User Services Agreement and Privacy Policy from time to time, and such revisions will be part of the Agreement. If such revisions result in a material reduction of your rights under the Agreement, we will notify you by prominently displaying the revisions on our home page or by sending you an email or otherwise before the revisions take effect. In such case, by continuing to use our Services, you agree to be bound by this User Services Agreement and Privacy Policy, as amended.
VII. Application of Law, Jurisdiction and Others
1. The Software solemnly reminds users of the terms and conditions in this Agreement that may exclude the liability of the Software and aggravate the obligations of the User, so please read them carefully and take the risks into account independently.
2. The laws of the People's Republic of China shall apply to the conclusion, entry into force, interpretation, amendment, supplement, termination, execution and dispute resolution of this Agreement.
3. Any dispute or controversy arising from this Agreement or the use of the Software shall be resolved by friendly consultation between the parties as far as possible; if consultation fails, either party shall have the right to take legal proceedings.
4. If any provision of this Agreement is deemed abrogated, invalid or unenforceable, such provision shall be considered to be independent and shall not affect the validity and enforceability of the remaining provisions.
